Terms of Service

These Terms of Service (“Terms”) are a contract between you and TakeTones (“we”, “us”) for the ElwoLinks product at links.taketones.com. By creating an account or using ElwoLinks you agree to these Terms and to our Privacy Policy.

If you use Facebook Login, you also agree to comply with the Meta Terms, Meta Platform Terms, and Meta Advertising Standards.

1. The service

ElwoLinks lets you create music smart links and, when you connect a Meta account, create and pause advertising campaigns in your Facebook ad account. You are the advertiser. Meta bills ad spend to you. We do not buy ads on your behalf from our wallet, and we do not guarantee streams, saves, playlist placement, or any music-chart result.

A smart-link click is not a stream. Analytics show visits, outbound clicks, and (when ads are connected) spend. We do not sell fake listeners.

2. Eligibility

You must be at least 18 years old. If you connect Facebook, you must have authority to authorize ElwoLinks on that ad account, Page, Instagram professional account, and pixel. You confirm the account is not used for prohibited businesses under Meta policies.

3. Account

You are responsible for your password and for activity on your account. Provide accurate email. We may suspend accounts that abuse the service, violate these Terms, or create risk for other users or Meta review.

4. Trial

New accounts receive a 7-day trial with limited launches (currently one smart link and two campaigns). No card is required for the trial. When the trial ends, smart links stay live, new launches are closed, and campaigns we created are paused. Paid plans (including Paddle checkout) may be offered later; they will have their own pricing at signup.

5. Facebook connection

Connecting Facebook is optional for creating a smart link and required to launch Meta ads. You authorize us to use the permissions you grant — including ads management, pages, and related business assets — solely to operate features you start in ElwoLinks (select assets, create/pause/resume campaigns, read stats, send ElwoClick events to your pixel).

You can disconnect in ElwoLinks Settings or in Facebook Settings → Apps and websites. Disconnecting does not cancel ads already running until they are paused or you change them in Ads Manager.

Until Meta approves public access for our app, Facebook Login may be limited to people Meta allows in development (app roles). That limit is Meta’s, not a separate paid tier.

6. Your content and ads

You retain rights to music, artwork, and ad creatives you upload or point us to. You grant us a limited license to host, transcode, and deliver them as needed to run ElwoLinks (smart-link pages, ad previews, and uploads to Meta that you request).

You are solely responsible for ad copy, targeting, landing pages, music rights, and claims. Ads and creatives must follow Meta Advertising Standards, copyright law, and the rules of Spotify, Apple Music, and any other destination. No misleading “guaranteed streams”, no fake engagement, no prohibited products, no unauthorized use of another artist’s identity.

7. Acceptable use

You may not: probe or disrupt the service; share login credentials; use ElwoLinks to violate Meta, Spotify, or Apple policies; upload malware; scrape other users; or use the product for anything other than legitimate music promotion.

8. Meta, Spotify, Apple

Those platforms are independent. Outages, policy enforcement, rejected ads, disabled ad accounts, or algorithm changes are outside our control. We are not a Meta reseller and not a Spotify official partner for playlist pitching.

9. Privacy

10. Intellectual property

ElwoLinks, the cabinet, and related software are owned by TakeTones or its licensors. You may not copy, reverse engineer, or resell the product except as allowed by law.

11. Disclaimers

The service is provided “as is”. We do not warrant uninterrupted operation, approval of your ads by Meta, or any performance of your music. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, TakeTones is not liable for lost profits, lost data, ad spend, rejected campaigns, or indirect or consequential damages. Our total liability for claims relating to ElwoLinks is limited to the greater of (a) amounts you paid us for ElwoLinks in the 12 months before the claim (excluding Meta ad spend) or (b) USD 50. These limits do not apply where the law forbids them, including liability for fraud or death/personal injury caused by negligence where such exclusion is not allowed.

13. Indemnity

You will indemnify TakeTones against claims arising from your ads, creatives, music rights, targeting, or violation of these Terms or Meta/Spotify/Apple rules.

14. Termination

You may stop using ElwoLinks and request deletion at any time. We may suspend or end access if you breach these Terms or if we must do so to comply with Meta or the law. Sections that should survive (including 6–13) survive termination.

15. Changes

We may update these Terms by posting a new version on this page. Continued use after the effective date means you accept the update. If you do not agree, stop using the service and request deletion.

16. Governing law

These Terms are governed by the laws of the United States and the State of California, excluding conflict-of-law rules, unless a mandatory consumer law in your country says otherwise. Courts located in California shall have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect the service.
